The process of lawmaking in India | A Brief study


                  The Parliament has an important role in making new laws and changing the existing ones. A proposal to pass a new law or change and existing one is called a bill. A bill introduced by a minister is called a government bill while a bill introduced by any private member of the Parliament is called Private member bill.                 Again, depending on the subject matter of a bill, it can be of two type- a money bill or an ordinary bill. Bills that deal with government income or expenditure are called money bills. Other bills that deal with the day-to-day life of the people are called ordinary bills.A bill becomes a law only after going through the following stages.

First Reading or the Introduction

                A bill is first read in a House of Parliament when a member of the House introduces it. All the members are given copies of the bill. The member who introduces the bill then explains the purpose of the bill. An ordinary bill can be introduced in either House of the Parliament.

Second Reading

                At this stage, the bill is discussed thoroughly amongst members of the Parliament who can then suggest possible changes. The bill may also be scrutinised by a select committee, which is a special body composed of selected members of different political parties in the House.

Third Reading 

                At this stage, the bill drafted again after making suitable changes. After it gets its final form, it is presented and put to vote. If the majority of the members present vote in favour of the bill, it is passed .

Bill in the Second House  

               The bill is then sent to the other house, where it goes through the same procedure. If passed by this House, it is sent to the President for his approval. The second House may also return the bill with suggestions. If these suggestions are unacceptable to the first House, the president summons a joint Session of the two Houses. If the bill is passed by the Joint session, it is sent for the President's assent.

President's Consent 

               The President either signs the bill or sends it back with suggestions. The Parliament then returns the bill to the President with or without the suggested changes. When the bill is so returned, the President has to sing it. The bill when signed by the President, becomes a law and is there after known as an Act.
